Terms of Service

AIHeadshotInstant (“the Service”) is an independent product built and operated by a solo developer based in mainland China. There is no company entity behind it — in these Terms, “I”, “me”, or “the developer” refer to that individual. By creating an account or using the Service, you agree to these Terms.

1. Acceptable use — only your own photos

You may upload only photos of yourself, or photos of another person for whom you hold explicit, written, revocable permission to generate AI portraits. Uploading photos of any other person — including celebrities, public figures, minors you are not the guardian of, or anyone whose consent you do not have — is strictly prohibited and is grounds for immediate termination without refund.

You also agree not to use the service to generate content that is unlawful, defamatory, sexually explicit, intended to deceive (e.g. identity fraud, fabricated credentials), or that infringes any third-party right.

2. Account responsibility

You are responsible for safeguarding your login credentials and for all activity under your account. Notify support@aiheadshotinstant.com immediately of any unauthorized access. You must be at least 16 years old to use the Service.

3. Your photos, your data — I do not keep them

The selfies you upload are processed solely to generate the headshots you requested, and deleted on the schedule described in the Privacy Policy (uploads within 24 hours; generated portraits within 30 days unless you delete them sooner). Your photos are never used to train any shared AI model, and no human routinely reviews them.

4. Subscription & billing

Paid plans renew automatically at the end of each billing period until cancelled. You may cancel from your account dashboard at any time; cancellation prevents future renewals but does not refund already-paid periods or unused credits. All sales are final per the Refund Policy.

5. Intellectual property

You own the generated portraits and may use them for any lawful purpose, including commercially, without attribution to AIHeadshotInstant. The underlying models, software, website, and brand remain the property of the developer and the upstream licensors whose models power generation.

You grant the developer a narrow, time-limited license to process your uploaded photos for the sole purpose of generating your portraits. This license terminates automatically when the photos are deleted under the retention schedule.

6. Service availability & AI output disclaimer

The Service is provided “as is” and “as available”, by a single individual developer with no formal SLA or guaranteed support hours. AI image generation is probabilistic: I do not guarantee that every portrait in a batch will meet your subjective standards, match your expectations of likeness, or be free of artifacts. I do not guarantee uninterrupted availability — the Service depends on third-party infrastructure that can have outages, and may itself be paused or discontinued with reasonable notice.

7. Limitation of liability

To the maximum extent permitted by law, the developer's total aggregate liability for any claim arising out of or relating to the Service is limited to the amount you actually paid for the Service in the 12 months preceding the claim. The developer is not liable for indirect, incidental, consequential, or punitive damages, or for any loss of profit, reputation, or opportunity.

Nothing in these Terms limits liability for matters that cannot be excluded under the applicable mandatory law of your place of residence (for example, personal injury or fraud).

8. Termination

You may stop using the Service at any time and delete your account from the dashboard. Accounts that violate these Terms may be suspended or terminated, with or without notice depending on the severity. Termination does not entitle you to a refund.

9. Changes to these Terms

These Terms may be updated from time to time. Material changes will be posted on this page and, for active accounts, sent by email at least 14 days before they take effect.

10. Governing law & disputes

These Terms are governed by the laws of the People's Republic of China (excluding conflict-of-law rules). Any dispute arising from or related to the Service shall be submitted to the people's court with jurisdiction at the developer's place of residence in mainland China.

If you are a consumer, the mandatory consumer-protection law of your country of residence still applies to the extent it grants you rights that cannot be contractually waived.
